Retrial: The Hidden Story of the Dover Case - Publisher's Introduction Why this book?! More than ten years have passed since the theory of “smart design” was ruled to be non-scientific by a judge of the Central District Court in Pennsylvania, USA, yet some still echo this story – a fallacy by any measure – as evidence that intelligent design is excluded from the flag circuit. “During those difficult months following the Dover case, I made the biggest decision of my career. Instead of stopping and running away, I decided to risk everything. Convinced of the utmost importance of intelligent design, I left my permanent position as a university professor, to devote all my energies to the Center for Culture and Science in Discovery. Dr. John West (now vice president of the Discovery Institute, and former professor of political science at Seattle University) wrote these lines in an article marking ten years of rule in Dover. He celebrated the failure of the atheist professor’s prophecy, and the failure of the judge, the plaintiffs, and their successors to try to put down a scientific theory using judicial power and political and media influence. The story began with an attempt by the administration of the Duffer School District in Pennsylvania to inform biology class students through a minute-long statement that Darwinian evolution is not the only theory that addresses the issue of the origin and diversity of life, and that there is another scientific theory called "intelligent design", and that those who want to learn more about it should read the book "Panda and People" in the school library. It is worth noting that the school administration acted alone, supported by neither the Discovery Institute nor the Foundation for Thought and Ethics, the publisher of the Panda Book. Indeed, the Discovery Institute administration asked them very much to avoid this early conflict. The school's management act gave the Darwinian lobby the golden opportunity to bring the same theory to court, their main issue not being that of the public school administration contrary to the U.S. Constitution, but that of trying to kill intelligent design theory by any means. The judiciary in any country is not immune to bias, but this bias reaches until the judge accepts the discussion of "scientific theories" within the corridors of the arbitrator, and gives himself the right to determine what qualifies as science, and then obliges the publisher of the book to hand over all drafts before and after the publication of the book, and then refuses to assign the publisher a lawyer to defend him, and then we ignore the reading of files provided by the defendant, and then we fake the statements of the defendants's witnesses, and then transfer entire pages in the drafts of his judgment! So this was a series, a retrial, in which we put through separate episodes, a retrial that evolutionists, atheists and believers, like to put first on the table, before the debate even began. If they had it that “the case is over,” we put this series to confirm that the case never ends so easily, or as Dr. Behe speculates at the end of his article here “On December 21, 2005, and as was the case before, there is no explanation for the mechanism other than the molecular.” In this edition, we begin with an article by John Peul, publisher of the book Panda, which tells the story of the Dover case for his part, and then turn to the comments of Dr. Michael Behe, professor of biological sciences at Lehigh University, Pennsylvania, who attended the trial in the defendant’s class as an expert.
